During a workshop on Tuesday, roughly 20 people learned how businesses can avoid lawsuits that claim they violated accessibility laws for people with disabilities.

Hosted by the Valley Economic Alliance and California Citizens Against Lawsuit Abuse, the workshop was part of a roughly yearlong effort to get businesses and restaurants compliant with accessibility laws as Glendale and surrounding cities gear up to host athletes participating in the Special Olympics World Summer Games, said Michael Hadley of the Valley Economic Alliance.Read more…

Town Creek dog park now open

Canines looking to fetch tennis balls, run through the grass at top speeds and wrestle with other four-legged friends, all free from the confines of a leash, can now do so at a second public park in Auburn.

A new dog park at Auburn’s Town Creek Park off South Gay Street opened on April 21, and all dogs and their owners are invited to enjoy the outdoors in a dog-friendly environment.

The park is located to the right of the restrooms inside the existing green space at Town Creek along the tree line. At 200 feet by 50 feet, it is slightly smaller than the dog park at Kiesel Park off Chadwick Lane, the only other designated dog park in the city. News by ALC Construction

Abuse of ADA a plague on California small businesses

Robert McCarthy is a serial litigant. And the Americans With Disabilities Act is the weapon he uses to shake down his victims.

Since 2001, McCarthy has filed more than 250 lawsuits against small businesses throughout the Golden State, alleging various violations under the federal law (which, in turn, constitute violations of California’s Civil Code).

Every infraction can cost $4,000. And with McCarthy alleging multiple infractions in most of his ADA suits, his victims have considerable motivation to pay him a reduced settlement to go away.

Here’s what particularly galls about McCarthy, who shamelessly exploits the fact that he is wheelchair-bound: He’s not a California resident. He resides in an Arizona assisted-living facility.

It’s because he finds California such a target-rich environment for ADA litigation that he makes a yearly trip to our fair state to seek out fresh prey. Read more…

The city of McMinnville is proposing to enforce a 48-inch wide right of way along downtown sidewalks

After receiving complaints about tables, chairs, sandwich boards and planters encroaching into the sidewalk right of way in downtown, the city is reminding downtown business owners that a swath 48 inches wide must be maintained under the Americans with Disabilities Act.

The McMinnville Downtown Association will be hosting a meeting at 8:30 a.m. Friday, April 17, at the Golden Valley Brewery &  Restaurant, to field merchant questions.

To accommodate the widest range of users, provide ramps with the least possible running slope and, wherever possible, accompany ramps with stairs for use by those individuals for whom distance presents a greater barrier than steps, e.g., people with heart disease or limited stamina.

405.3 Cross Slope. Cross slope of ramp runs shall not be steeper than 1:48.

Advisory 405.3 Cross Slope. Cross slope is the slope of the surface perpendicular to the direction of travel. Cross slope is measured the same way as slope is measured (i.e., the rise over the run).

BOSSIER CITY, LA (KSLA) – One of Bossier City’s three public pools is not in compliance with the American with Disabilities Act. Now, city leaders may have to dig deep into their pockets to reopen the pool in May.

According to Bossier City Attorney Jimmy Hall, even though the Shed Road pool house otherwise referred to as “Meadowview pool”, has a handicap lift for the pool, the spaces inside the pool house itself aren’t wide enough for wheelchairs.

The issue was brought to light when this summer, a grandpa couldn’t get around inside the pool house to help his grandchild. It’s a problem community member Jojo Sutis can understand, “I can totally see someone needing the handicap accessibility wanting that to be available,” she said.

“If we don’t come into compliance we are going to get a lawsuit about it. We have to have a compliant facility, so it is not an optional deal,” said Hall at Tuesday’s City Council meeting. Read More…

Small Business Owners Feel Victimized by “Love Affair With Lawsuits”

ADA-CaliforniaNearly 8 million lawsuits were filed against business owners last year, taking what some consider a hefty and unfair toll on the economy. Now, one group is demanding an end to “lawsuit abuse.” John Cádiz Klemack reports for the NBC4 News at 6 p.m. on Friday, Sept. 26, 2014.

Logansport sets out to improve access to citizens with disabilities

Complying with federal accessibility regulations will cost the City of Logansport more than $8 million, according to a recently issued report.

A consulting firm hired this summer by the city researched the cost of aligning with federal regulations and making Logansport public facilities more accommodating for people with disabilities.

Like communities all over the country, the city is taking steps to comply with the Americans With Disabilities Act passed by the U.S. Congress in 1990. The civil rights law prohibits discrimination based on disability, part of which concerns ensuring counties, cities and towns provide ways to make public facilities accessible to those in wheelchairs and who have other disabilities.

SACRAMENTO – At Fine Line Trim & Upholstery in Rancho Cordova, owner Victor Valdivia is paying a price.

“Every month it’s $2,000,” Valdivia said.

Those monthly payments go to Valdivia’s attorney as he fights a lawsuit brought by a Carmichael man for violations of the Americans with Disabilities Act, or ADA.

The lawsuit was brought by 51-year-old Scott Johnson.

Melissa Jaros didn’t know what to think when she received an unexpected letter in the mail on Aug. 29.
A man she didn’t know was threatening to sue her if she didn’t send him $5,000 and make changes to the parking lot of her Streamwood business, Grooming Unleashed.
Streamwood lawyer threatens lawsuits over lack of handicapped spaces
The letter, written by disabled Streamwood resident Andrew Straw, stated Jaros’ business is in violation of the American with Disabilities Act and because of that, he was seeking damages and a quick fix that included curb cuts and better signage for handicapped parking.

Confused and a bit offended, Jaros threw out the letter.

Grooming Unleashed is one of more than a dozen businesses Straw sent the correspondence to a few weeks ago. His demand letters have created a stir among members of the village’s business community, many of whom are suspicious of his intentions. The executive director of the Streamwood Chamber of Commerce even called police after getting the letter, worried it was a scam.
