406 Curb Ramps

406.1 General. Curb ramps on accessible routes shall comply with 406, 405.2 through 405.5, and 405.10.

406.2 Counter Slope. Counter slopes of adjoining gutters and road surfaces immediately adjacent to the curb ramp shall not be steeper than 1:20. The adjacent surfaces at transitions at curb ramps to walks, gutters, and streets shall be at the same level.

In cross section, a curb ramp with a maximum slope of 1:12 adjoins a surface at the bottom that has a maximum counter slope of 1:20.

406.3 Sides of Curb Ramps. Where provided, curb ramp flares shall not be steeper than 1:10.

A curb ramp with triangular flared sides is shown. The flared sides have a maximum 1:10 slope, measured at the curb face.

406.4 Landings. Landings shall be provided at the tops of curb ramps. The landing clear length shall be 36 inches (915 mm) minimum. The landing clear width shall be at least as wide as the curb ramp, excluding flared sides, leading to the landing.

EXCEPTION: In alterations, where there is no landing at the top of curb ramps, curb ramp flares shall be provided and shall not be steeper than 1:12.

A plan view of a curb ramp shows the required top landing which has a length of 36 inches (915 mm) minimum in the direction of the ramp run and is at least as wide as the ramp.

406.5 Location. Curb ramps and the flared sides of curb ramps shall be located so that they do not project into vehicular traffic lanes, parking spaces, or parking access aisles. Curb ramps at marked crossings shall be wholly contained within the markings, excluding any flared sides.

406.6 Diagonal Curb Ramps. Diagonal or corner type curb ramps with returned curbs or other well-defined edges shall have the edges parallel to the direction of pedestrian flow. The bottom of diagonal curb ramps shall have a clear space 48 inches (1220 mm) minimum outside active traffic lanes of the roadway. Diagonal curb ramps provided at marked crossings shall provide the 48 inches (1220 mm) minimum clear space within the markings. Diagonal curb ramps with flared sides shall have a segment of curb 24 inches (610 mm) long minimum located on each side of the curb ramp and within the marked crossing.

A space 48 inches (220 mm) minimum, measured in the direction of the ramp run, is provided at the bottom of the ramp outside active traffic lanes and within the boundary of the marked pedestrian crossing. Sections of curb 24 inches (610 mm) minimum in length are shown beyond the flared sides and within the marked crossing.

406.7 Islands. Raised islands in crossings shall be cut through level with the street or have curb ramps at both sides. Each curb ramp shall have a level area 48 inches (1220 mm) long minimum by 36 inches (915 mm) wide minimum at the top of the curb ramp in the part of the island intersected by the crossings. Each 48 inch (1220 mm) minimum by 36 inch (915 mm) minimum area shall be oriented so that the 48 inch (1220 mm) minimum length is in the direction of the running slope of the curb ramp it serves. The 48 inch (1220 mm) minimum by 36 inch (915 mm) minimum areas and the accessible route shall be permitted to overlap.

Figure (a) is a plan view of a raised pedestrian island with a walkway cut through at the same level as the street crossing. Figure (b) is a plan view of a raised pedestrian island between two traffic lanes. Aligned curb ramps with side flares slope down on each side. The level space between the top of both ramps is 48 inches (1220 mm) long minimum. The width of both ramp runs is 36 inches (915 mm).

Canines looking to fetch tennis balls, run through the grass at top speeds and wrestle with other four-legged friends, all free from the confines of a leash, can now do so at a second public park in Auburn.

A new dog park at Auburn’s Town Creek Park off South Gay Street opened on April 21, and all dogs and their owners are invited to enjoy the outdoors in a dog-friendly environment.

The park is located to the right of the restrooms inside the existing green space at Town Creek along the tree line. At 200 feet by 50 feet, it is slightly smaller than the dog park at Kiesel Park off Chadwick Lane, the only other designated dog park in the city. News by ALC Construction

Advisory 405.2 Slope. To accommodate the widest range of users, provide ramps with the least possible running slope and, wherever possible, accompany ramps with stairs for use by those individuals for whom distance presents a greater barrier than steps, e.g., people with heart disease or limited stamina.

405.3 Cross Slope. Cross slope of ramp runs shall not be steeper than 1:48.

Advisory 405.3 Cross Slope. Cross slope is the slope of the surface perpendicular to the direction of travel. Cross slope is measured the same way as slope is measured (i.e., the rise over the run).

405.4 Floor or Ground Surfaces. Floor or ground surfaces of ramp runs shall comply with 302. Changes in level other than the running slope and cross slope are not permitted on ramp runs.

405.5 Clear Width. The clear width of a ramp run and, where handrails are provided, the clear width between handrails shall be 36 inches (915 mm) minimum.

Proponents of the expansion say that the cost to fix the ADA problems is $38 million. Whatever the cost, something has to be done.

Michael Brunick knows the difficulties of getting around the Barnett Arena first hand.
“The ADA seating is in a place where the view isn’t very good and the egress in case of a problem is scary,” Brunick said.
Brunick isn’t focused on why this is being addressed now. He’s just glad it is.
“For me its kind of a moral issue,” he said. “I know everyone wants to say ‘Oh, we really want to fix the ADA,’ but when it comes down to spend the penny for it they very rarely want to vote for it.”

‘Missing Link’ in San Fernando Valley L.A. River Trail Launches

It didn’t look like much right then. The overcast sky combined with the interminable brown and gray of dirt path meeting concrete didn’t help much either, but in by spring 2016, this overlooked piece of land just north of Ventura Boulevard will be replaced with a $2-million Zev Yaroslavsky L.A. River Greenway Trail, a new half-mile trail dotted with more than 4,000 native trees and plants including Coast Live Oak, Toyons, California poppy flowers. It would connect a 2.5 mile section of the river trail from Whitsett Avenue almost to the CBS Studios and a 2-mile section from Coldwater Canyon upstream.

“It will create five miles of continuous pathways, the longest in San Fernando Valley,” said Esther Feldman, President of Community Conservation Solutions (CCS), the non-profit organization who led the development of the project, addressing a crowd of more than 140 people. CCS also helped piece together the public and private funding to realize the trail. Funding came from the California Natural Resource Agency, Santa Monica Mountains Conservancy, Caltrans, and Supervisor Zev Yaroslavsky’s discretionary Proposition A Regional Park and Open Space fund. Apart from those, the city of Los Angeles and the Studio City Residents Associated has also committed money.

There’s a name change in the works for the Museums of Los Gatos–it’s NUMU, and it stands for the New Museum Los Gatos that opens next year at the civic center. The art museum on Tait Avenue and the history museum at Forbes Mill will be combined into one facility, taking over the old library that has been mostly vacant since February 2011.

Earlier this month the town council appropriated nearly $1.4 million to upgrade the old library building with new heating, air conditioning, restrooms, lighting and an ADA-compliant elevator.
“This project has several themes,” parks and public works director Matt Morley said. “The most important of these may be the focus on accessibility–ensuring through the installation of a new elevator, a revamped stairwell and reconstructed restrooms that all patrons have access to the full space.” Read More…

Melissa Jaros didn’t know what to think when she received an unexpected letter in the mail on Aug. 29.
A man she didn’t know was threatening to sue her if she didn’t send him $5,000 and make changes to the parking lot of her Streamwood business, Grooming Unleashed.
Streamwood lawyer threatens lawsuits over lack of handicapped spaces
The letter, written by disabled Streamwood resident Andrew Straw, stated Jaros’ business is in violation of the American with Disabilities Act and because of that, he was seeking damages and a quick fix that included curb cuts and better signage for handicapped parking.

Confused and a bit offended, Jaros threw out the letter.

Grooming Unleashed is one of more than a dozen businesses Straw sent the correspondence to a few weeks ago. His demand letters have created a stir among members of the village’s business community, many of whom are suspicious of his intentions. The executive director of the Streamwood Chamber of Commerce even called police after getting the letter, worried it was a scam.

National Council on Disability Explores Scope of and Solutions to Veterans Backlog

In partnership with current and former service members, the National Council on Disability (NCD) – an independent federal agency that advises the President, Congress and other federal agencies on disability policy – has released a report titled,  “Clearing the Backlog and Facilitating Benefits for America’s Veterans.” The 80-page report includes opinions and evaluations by key stakeholders, buoyed by the insights of experts, in addressing the current state of the Department of Veterans Affairs (VA) disability claims backlog.

NCD thanks Paralyzed Veterans of America for numerous, invaluable contributions in preparing this report.

“In the same spirit with which Americans honor all Veterans for their service to our country, the National Council on Disability has chosen National Military Families month and the day after Veterans Day to offer these recommendations to help clear the backlog in getting necessary supports to U.S. Veterans,” said NCD member Captain Jonathan Kuniholm, USMC (Retired). “Making good on the promises made to Veterans with service-connected disabilities and health issues, financial uncertainty, and other hardships when adjusting to civilian life in a timely manner is the least that we can do for those ‘who shall have borne the battle.’ NCD hopes this report can facilitate meaningful improvements across numerous areas of concern.”

“NCD’s findings and recommendations focus on necessary actions that need to be taken to reduce the VA claims backlog,” said NCD member Janice Lehrer-Stein. “Improvements have been made, but more needs to be done. NCD recognizes the important and ongoing progress that has been made to date and remains available to assist in the collaboration of all federal agencies to find the best and most coordinated way forward.”

Title I requires employers with 15 or more employees to provide qualified individuals with disabilities an equal opportunity to benefit from the full range of employment-related opportunities available to others. For example, it prohibits discrimination in recruitment, hiring, promotions, training, pay, social activities, and other privileges of employment. It restricts questions that can be asked about an applicant’s disability before a job offer is made, and it requires that employers make reasonable accommodation to the known physical or mental limitations of otherwise qualified individuals with disabilities, unless it results in undue hardship. Religious entities with 15 or more employees are covered under title I.

Title I complaints must be filed with the U. S. Equal Employment Opportunity Commission (EEOC) within 180 days of the date of discrimination, or 300 days if the charge is filed with a designated State or local fair employment practice agency. Individuals may file a lawsuit in Federal court only after they receive a “right-to-sue” letter from the EEOC.

Charges of employment discrimination on the basis of disability may be filed at any U.S. Equal Employment Opportunity Commission field office.
