Title I requires employers with 15 or more employees to provide qualified individuals with disabilities an equal opportunity to benefit from the full range of employment-related opportunities available to others. For example, it prohibits discrimination in recruitment, hiring, promotions, training, pay, social activities, and other privileges of employment. It restricts questions that can be asked about an applicant’s disability before a job offer is made, and it requires that employers make reasonable accommodation to the known physical or mental limitations of otherwise qualified individuals with disabilities, unless it results in undue hardship. Religious entities with 15 or more employees are covered under title I.

Title I complaints must be filed with the U. S. Equal Employment Opportunity Commission (EEOC) within 180 days of the date of discrimination, or 300 days if the charge is filed with a designated State or local fair employment practice agency. Individuals may file a lawsuit in Federal court only after they receive a “right-to-sue” letter from the EEOC.

Charges of employment discrimination on the basis of disability may be filed at any U.S. Equal Employment Opportunity Commission field office. Field offices are located in 50 cities throughout the U.S. and are listed in most telephone directories under “U.S. Government.” For the appropriate EEOC field office in your geographic area, contact:

The Americans with Disabilities Act of 1990 requires the Department of Justice, along with other Federal agencies, to provide “technical assistance to individuals and insitutions that have rights or duties” under this law. The Department produced technical assistance materials for its 1991 ADA regulations implementing Title II (State and local governments) and Title III (public accommodations and non-profit service providers) and again in 2010 when the Department revised its ADA regulations for both titles.

Wheelchairs on buses not always secured

Screen Shot 2013-03-04 at 5.07.24 PMLOS ANGELES (KABC) — It’s tough enough for most of us to get around L.A., but imagine if you were confined to a wheelchair and forced to rely on public transportation. The L.A. County Metropolitan Transportation Authority (MTA) says safety is its first priority for the millions of bus and rail-car riders it serves every year. But disabled riders who spoke to ABC7 Eyewitness News tell a much different story. In a two-month undercover investigation, we attached hidden cameras to the wheelchairs of some of those riders. We found violations of federal civil rights law, and some drivers putting the lives of their passengers at risk.

The hearing will focus on an upcoming Notice of Proposed Rulemaking on accessibility guidelines for ferries, cruise ships, excursion boats, and other passenger vessels. A panel discussion entitled, “Architecture and Urban Planning for the 21st Century: How Can We Foster Accessibility?” will occur after the hearing. Members of the public may ask questions and make comments. The public also is invited to attend the reception at 5:30 pm.
